Introduction This contract is designed to protect you (the Couple) and Samantha Jane Photography (THE PHOTOGRAPHER). Its purpose is to agree down in writing exactly what you, as a client, can expect to receive and what I as Photographer must provide. Please note that I see many couples and it is not always possible to remember exactly what has been agreed at each meeting, therefore this contract shall take precedence over all verbal discussions between THE PHOTOGRAPHER and the Couple and its contents form our contract. It is mutually agreed that the terms of agreement herein form part of this contract and that no variation or modification of this contract shall be effective unless accepted by both parties in writing, up to 7 days before the wedding day. The Product THE PHOTOGRAPHER agrees to be in attendance on the wedding date above and to take photographs during the day. THE PHOTOGRAPHER agrees that THE COUPLE will be provided with photographic services and products as detailed in the package description below, selected by THE COUPLE. The Package The wedding photography package offered by THE PHOTOGRAPHER includes: BRONZE PACKAGE Travel in the UK All day coverage from the Bridal Preparations to the first dance. 450+ High Resolution, professionally edited images with full printing rights. A password protected online gallery where you share your images with friends & family. Unlimited downloads for your friends and family An app to view on mobile devices. SILVER PACKAGE Travel in the UK All day coverage from the Bridal Preparations to the first dance. 700+ High Resolution, professionally edited images with full printing rights. A password protected online gallery where you share your images with friends & family. Unlimited downloads for your friends and family An app to view on mobile devices. GOLD PACKAGE Travel in the UK All day coverage from the Bridal Preparations to the first dance. 700+ High Resolution, professionally edited images with full printing rights. A password protected online gallery where you share your images with friends & family. Unlimited downloads for your friends and family An app to view on mobile devices. 8"x8" Fine Art Album The package price quoted at time of booking will be honoured, regardless of the date of the wedding day and whether prices rise or fall. Schedule of Payments Of the total package price, £300 is paid as a non-refundable booking fee unless agreed otherwise. The remainder of the overall package price must be received at least 6 weeks before the wedding date. The Couple agree that failure to comply with the above schedule will release THE PHOTOGRAPHER from all obligations under the contract and that all fees paid will be forfeited. Late payments will incur a £50 surcharge. Force Majeure or Act of God: In the unlikely event of total or part photographic equipment failure, death, injury or sickness or any other circumstance beyond THE PHOTOGRAPHER’S control such as natural disasters (earthquakes, hurricanes, floods). War, Riots or other major upheaval or performance failures outside the control of the contracting party THE PHOTOGRAPHER’S liability shall be limited to a full refund of all monies paid. Limitation of Liability and Disclaimer: 1. THE PHOTOGRAPHER agrees that every effort will be made to provide high quality photographic services. In the unlikely event that a catastrophic mechanical failure should occur to THE PHOTOGRAPHER’s equipment or that THE PHOTOGRAPHER is unable to provide the Couple with the agreed upon photography services and/or products, THE PHOTOGRAPHER and THE COUPLE agree that THE PHOTOGRAPHER is not responsible for any other consequential damages, emotional or otherwise and that THE PHOTOGRAPHER’s liability shall be limited to a full refund of all monies paid. THE COUPLE agree that an entire wedding cannot be replicated, re-enacted or repeated for the purpose of a re-shoot and limits THE PHOTOGRAPHER’s liability to the refund of all monies paid under this contract. Neither party shall be liable for indirect or consequential loss. 2. THE PHOTOGRAPHER agrees that every effort will be made to provide the requested images. However THE PHOTOGRAPHER will not be held responsible for any shots missed due to unforeseen circumstances such as weather, willingness of subjects & rules imposed by the venue & it's officials. 3. If a photographic record is required of a specific guest then THE COUPLE agree it is their responsibility to bring said guest to THE PHOTOGRAPHER. 4. In the event of illness, THE PHOTOGRAPHER will endeavour to find a replacement to cover the wedding day. If a replacement photographer cannot be found, THE PHOTOGRAPHER’s liability will be limited to a refund of all monies paid Cancellation: If THE PHOTOGRAPHER has to cancel this contract for reasons beyond their control, for example including but not limited to death, injury or sickness, THE PHOTOGRAPHER’s liability shall be limited to a full refund of all monies paid. The client may cancel this contract at any time, subject to the following charges: 60 days or less – total package price 61-90 days – 75% of total package price 91+ days – booking fee only Should the date of the wedding day change, then subject to availability, all monies paid may be applied to the new date. If THE PHOTOGRAPHER is not available on the new date(s) and the Couple cancel the wedding day then cancellation fees apply as above. THE COUPLE may cancel this contract within 14 days of signing without giving any reason by giving written notice to THE PHOTOGRAPHER. If the right to cancel is exercised within 14 days then any monies paid to THE PHOTOGRAPHER will be reimbursed. THE PHOTOGRAPHER reserves the right to make a deduction from the reimbursement for loss in any value of any goods or services supplied. The reimbursement will be made without undue delay. After 14 days the client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit any monies paid. Privacy THE PHOTOGRAPHER will store your name and wedding details. These details will not be made available to any individual or organisation other than THE PHOTOGRAPHER and THE PHOTOGRAPHER’s staff, and will only be used in relation to the purposes of the business. Copyright & Model Release 1. THE PHOTOGRAPHER is the only authorised photographer for the day. Other professional photographers are not permitted whether official or otherwise, working for pay or otherwise (e.g, separately employed by parents, contracted by magazines or newspapers), unless agreed in writing before the day. Breach of this condition shall be deemed cancellation of the contract by the clients. 2. COPYRIGHT: The 1998 Copyright, Designs and Patents Act assigns copyright to Samantha Jane Photography. You may not copy the photographs taken under this contract, or allow copies to be made photographically, electronically, or by any other means for commercial purposes or profit. No alterations are to be made to the photographs taken under this contract for any purpose. License to Reprint & Redistribute Where high-resolution digital images are provided to the Couple, I THE PHOTOGRAPHER give THE COUPLE licence and right to reprint those images and distribute for personal use, as well as the use of low-resolution images on a personal website or social networking websites only. They may not be sold or used in any commercial publication or website without the prior consent of THE PHOTOGRAPHER. Colour Matching THE PHOTOGRAPHER cannot guarantee exact colour matching. It is sometimes impossible to digitally record the exact colour as seen by the human eye. Artistic Licence THE PHOTOGRAPHER shall strive to accommodate reasonable requests concerning locations used and group shots taken. THE PHOTOGRAPHER shall however be granted artistic licence during the production and post production of THE COUPLE’s wedding photographs. Due to the vagaries of the weather and the willingness of subjects, it may not be possible to capture all the photographs requested. Client Cooperation THE COUPLE is responsible for the conduct of their guests. THE PHOTOGRAPHER will not tolerate verbally or physically abusive behaviour, nor share their time or compete with guest photographers for the attention of THE COUPLE. Guest conduct that interferes with the wedding photography may seriously affect the quality of the photographs taken and increase the number of times photos must be re-taken. If THE COUPLE is unable to manage the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of THE PHOTOGRAPHER, it will result in the early or immediate departure of THE PHOTOGRAPHER. THE COUPLE understand that in such an event, no refunds will be granted. Signatories We, the undersigned parties, having had the opportunity to seek legal advice with regards to this contract, do hereby warrant that we are competent to contract in our own names. We confirm that we have read the contents of this agreement prior to its execution and that we are fully familiar with the contents herein. This agreement becomes effective immediately and shall be binding upon us and our heirs, legal representatives and assigns.
